Chapter 7 Bankruptcy - Discharge of Debts
In a Chapter 7 bankruptcy proceeding, you agree to sell or liquidate certain assets in exchange for the discharge of specific debts. Some obligations, such as child support arrearages, student loans and some tax debts, cannot be extinguished through a bankruptcy filing. Likewise, you will not be required to sell all of your assets to satisfy obligations to your creditors. Your primary residence and vehicle are among the items that may be exempt from a Chapter 7 liquidation.
Under the previous bankruptcy law, almost anyone could file for protection under Chapter 7. The revised bankruptcy law makes it more difficult to file a Chapter 7, requiring that you submit to a "means test" to determine whether you qualify. We will review your situation in light of the requirements of the means test to help you determine whether a Chapter 7 filing is available to you. We will make certain, before you file, that you understand what you may discharge through a consumer bankruptcy and what assets you may be able to protect.
Chapter 13 Bankruptcy - Repayment Plans
In a Chapter 13 bankruptcy filing, you agree to repay your creditors over a period of 3-5 years. During the course of the bankruptcy, you will meet with your creditors and seek to negotiate repayment terms. We will act as your advocate in all proceedings with creditors.
If you are able to reach agreement with a creditor, you can take your proposed settlement to the bankruptcy court for approval. If you are unable to find a resolution agreeable to both parties, the bankruptcy judge will propose repayment plans.
We will review any settlement offers to make certain they are within your means. If you enter into an agreement with a creditor and fail to keep the promise, you can lose the protections afforded under the bankruptcy law.
